A left-wing judge in blue Illinois has decided that illegal aliens have a “constitutional right” to own firearms, even as crime committed by Joe Biden’s illegal border crossers is soaring.
The ruling comes in the case of illegal alien Heriberto Carbajal-Flores, who was arrested in 2020 and was found in possession of a gun. It is a violation of Title 18 of the U.S. Criminal Code for an illegal to have a gun.
U.S. District Court Judge Sharon Johnson Coleman of the Northern District of Illinois, an Obama appointee, reversed the rulings of a lower court that maintained that Carbajal-Flores was guilty. Coleman ruled that Carbajal-Flores has a legal right to a gun.
“The Court finds that Carbajal-Flores’ criminal record, containing no improper use of a weapon, as well as the non-violent circumstances of his arrest do not support a finding that he poses a risk to public safety such that he cannot be trusted to use a weapon responsibly and should be deprived of his Second Amendment right to bear arms in self-defense,” Coleman exclaimed in his ruling.
“The noncitizen possession statute, 18 U.S.C. § 922(g)(5), violates the Second Amendment as applied to Carbajal-Flores. Thus, the court grants Carbajal-Flores’ motion to dismiss,” Coleman said.
Oddly enough, some gun rights advocates are saying this is a good ruling because the statute violates the “inalienable right” of owning a gun in this country. These folks say that gun rights would apply to everyone in this country.
Fair enough, to a point.
But no one feels that foreigners are covered under the U.S. Constitution.
Furthermore, this Carbajal-Flores fellow did not legally obtain the gun he was caught with. And no one is permitted to do that, not even citizens.
This ruling also comes as crime by Joe Biden’s illegal aliens has been soaring.
But perhaps one of the most galling things of all is that this is a case where a liberal judge has finally discovered a case where he feels someone deserves protection of his right to own a gun.
And he isn’t even an American.
