Jesse Ventura may be the only ex-Navy Frogman launched a defamation suit against the estate of a Former seal who was a war hero, over a incident mentioned in the hero’s book. The hero being Chris Kyle, the most lethal sniper in U.S. Military History, and the incident related in his book American sniper doesn’t even mention the self-serving creep. In the first round Ventura who doesn’t need the cash, took $1.8 million fromTaya Kyle, the widow of the war hero.  But on Monday an appeals court reversed the decision.

A federal appeals court on Monday tossed out  the $1.8 million in damages awarded to former Minnesota Gov. Jesse Ventura, who said he was defamed by the late author Chris Kyle in the bestselling book “American Sniper,” in a passage of the book where he wasn’t mentioned

A three-judge panel threw out the $1.35 million awarded to Ventura for “unjust enrichment,” saying Minnesota law did not allow a payout in this type of case; and in a 2-1 decision, it reversed the $500,000 award for defamation, remanding the case to the district court for a new defamation trial.

 

(…)The court found that the unjust enrichment claim was not applicable in Ventura’s case.

 

In order to prevail on such a claim, Ventura would have had to establish that he had at least a “preexisting contractual or quasi-contractual relationship with Kyle,” the ruling said.

As for the defamation,even if the Kyle story was about Ventura, it was the former Minnesota Gov./WWF Star/ conspiracy theorist who outed himself as the person in that passage of the book.  More importantly, nothing defames Ventura more than his weird conspiracy theories and of course the fact that he tried to take $1.8 million from the widow of a war hero.

The reason two of the three judges decided to overturn the $500K defamation award was due to the fact that Ventura’s lawyer mentioned that insurance may pay the award making the jury believe that the money would not come out of Taya Kyle’s pocket (which is irrelevant to the case but makes a jury more likely to make an award).

In the end it doesn’t matter because a decade from now Chris Kyle will still be recognized as a hero, Taya Kyle the widow of a war hero,  and Jesse Ventura will be remembered as a clown, and a low-life scumbag who took almost $2 Million from the widow of a war hero, and then continue to try and disparage his memory.

In previous interviews, Ventura vowed to move permanently to Mexico where he has a winter home, if he lost the case.
